Terms of Service

1. INTRODUCTION
The following Terms of Service define the conditions under which apartment accommodation bookings may be made. Making a booking is equivalent to accepting the Terms of Service. The rental contract is entered into between Pantheon Apartments, hereinafter referred to as the owner, and a user of the reservation system, hereinafter referred to as the guest.

2. MAKING A RESERVATION
To make a reservation, the guest should begin by either filling in the 'Check Availability & Get a Quick Quote' form provided on the website; or sending an email by clicking on either 'electronically here' link at the bottom of the website. The owner will then respond with availability and pricing information. Upon confirmation by the guest to reserve an available apartment, the owner will send an invoice (e.g., PayPal invoice) for a non-refundable deposit of 30% of the total rental costs to secure the apartment. The deposit can be paid by any method allowable in the invoice system. The guest will have 48 hours to pay the invoice, or the reservation is subject to cancellation. Within 48 hours of payment, the guest will receive an email confirmation of their payment, which will act as their booking voucher, with all check-in details, in particular the contact details of the person responsible for the keys to the accommodation. On arrival the guest is obliged to pay the remaining amount of the rental costs to the person responsible for the keys. The balance due is paid in cash. Other payment terms can be agreed on a case-by-case basis (e.g., paying the balance via credit card), if agreed at the time of reservation.

3. GUARANTEE OF THE LOWEST PRICE
All apartment properties presented on the website fall under the Lowest Price Guarantee Program as follows:
a) The owner guarantees that if a client finds the same apartment property for the same period of time and the same number of people at a lower price on another website before making a reservation or within 72 hours after having made it, the price for the stay will be reduced to the price offered on the other websites plus 5% discount off that price.
b) To take advantage of the guarantee mentioned in Section 3a above, the following conditions must be fulfilled:
i) the client must send an e-mail to: pantheon_apartments@yahoo.com with a clear screen print of the page where the particular apartment property is presented, with the visible website address on it and other details which allow the identification of the property, along with the price, the term of stay and the number of people which the price concerns,
ii) the offer of the apartment property must exist under the website address given in the e-mail in the moment when the owner receives it. The moment of receiving the e-mail can occur within 2 full operating hours, counting from the moment when the e-mail reached the owner's e-mail box.
c) After verifying the authenticity of the notification described in Section 3bi above, the owner:
i) will reduce the price of the reservation which has already been made, what is set out in Section 3a,
ii) will make a reservation at a reduced price, if requested, as set out in Section 3a.
d) In the event of an offer being interpreted differently by the client and the owner of the apartment, in particular with regard to the booking price and the sameness of the offer which the price concerns, the owner's interpretation will stand. Any aggrieved party can apply to the competent, according to the provisions of the Civil Code, court for remedy, if they do not accept this interpretation.

4. SCOPE OF RENTAL CONTRACT
The contract made between the owner and the guest comprises only and exclusively the act of renting. Travel arrangements, full board and an itinerary are the guest's responsibility. The total rental costs are provided via email, per the process in Section 2 above. The total rental costs include utilities (gas, electricity, water) as well as the final cleaning service. The owner will not charge any additional fees other than those quoted via email during the time of reservation.

5. ARRIVAL, KEY COLLECTION, DEPARTURE
The guest should agree their arrival time at the apartment with a person responsible for the keys. One day before arrival or earlier, the guest is obliged to inform this person about their planned arrival time to collect the keys. The guest can check-in from 2 pm on the arrival day and must check out by noon on the departure day unless they agree different times with the person responsible for the keys. If the guest is not able to arrive at the previously arranged time, they are obliged to contact the person responsible for the keys by phone immediately. The guest is obliged to pay the amount of money specified in the booking voucher, even though, for reasons independent of the owner, their arrival is delayed or the number of nights are reduced (i.e. transportation difficulties, strikes, personal reasons).

6. OBLIGATIONS OF THE GUEST
The number of occupants of the property is subject to the number specified in the booking voucher. In case of extra occupants the guest is obliged to contact the owner by phone or by e-mail prior to arrival. If the number of occupants is greater than the number specified in the booking voucher, a person responsible for the keys is under no obligations to hand them over. The guest is obliged to observe the rules of good neighborliness and to return the property in the same conditions they found it. Before the guest checks out they must wash the dishes and all kitchen appliances as this activity is not included in the final cleaning service. The guest is obliged to inform the person responsible for the keys about defects and faults found in the property, if any, as well as to report all damage caused by them during their stay. The guest shall cover the full costs of any damage. The owner of the damaged property will decide the method of compensation.

7. RESERVATION AMENDMENTS
a) Change of date of stay
The booking deposit is non-refundable. The guest can change the dates of their reservation provided that the change concerns the same property and the length of stay remains the same. The change can be made up to 14 days ahead of the scheduled arrival date. The guest must contact the owner directly to make any changes to an existing reservation. If the guest chooses dates for a more expensive season they are obliged to cover the difference in price on arrival.
b) Prolongation of stay
The guest can add nights to their booking, if available. In order to prolong their stay the guest should contact the owner by phone, or e-mail.
c) Change of number of occupants
The number of occupants specified in the booking voucher may be changed provided that the total number of guests is within sleeping capacity of the chosen property. In order to make the change the guest should contact the owner by phone, or e-mail.

8. TRANSFERRING THE GUEST'S RIGHTS AND RESPONSIBILITIES TO ANOTHER PERSON
At any time the guest may transfer all the rights of their reservation to another person if this person accepts all the duties resulting from the reservation. The guest is obliged to contact the owner immediately to inform them about the change and to give the contact details of the person who will assume the rights and duties of the rental contract.

9. COMPLIMENTARY STAY OF A CHILD
A child under the age of 5 (one per two adults) who shares sleeping arrangements with adults or is in a cot, and needs no additional bedding, does not have to pay a per-person rate during the whole stay. On making a reservation the guest states the number of persons in the reservation form excluding any complimentary children but children's age must be provided in the field 'Comments'. Children other than those specified above must be counted among the number of occupants.

10. FORCE MAJEURE
In case of circumstances beyond the owner's reasonable control they reserve the right to provide substitute accommodation similar to the accommodation initially booked. The owner has the right to cancel the rental contract in case of events caused by force majeure. This also concerns cases where safety of the guest and their belongings, for reasons beyond the owner's control, cannot be guaranteed. The amount of money paid by the guest will be returned upon deduction of the amount charged for the service already provided.

11. JURISDICTION
In case of any conflicts between the owner and the guest Polish law is applicable. All legal proceedings shall be conducted by the competent court with a territorial jurisdiction covering the area where the owner has their headquarters.
